MTech makes no warranties, express or implied, including but not limited to:

• Non-infringement

MTech does not guarantee the accuracy, timeliness, completeness, or reliability of any data or information provided.
You acknowledge that your use of the Services is at your own risk.

In no event shall MTech be liable for any direct, indirect, incidental, punitive, special, or consequential damages (including, but not limited to, lost profits, trading losses, security breaches, service interruptions, or errors in data), even if MTech has been advised of the possibility of such damages.

2. Prohibited Uses

Users agree not to:

1. Interfere with the operation or security of MTech systems through the use of viruses, malware, or any disruptive technologies.
2. Modify, decompile, reverse engineer, or create derivative works from any MTech software or technology.
3. Attempt to gain unauthorized access to proprietary information, data, or systems.
4. Engage in activities that disrupt or degrade the performance of MTech’s Services.
5. Use VPNs, proxies, or similar technologies that mask or hide device or IP information while accessing MTech systems.

3. Use of Market Data

Users and their affiliates may use exchange and source provider data obtained through MTech solely for internal trading or analytical purposes.

You may create derivative works from such data for your own internal use. However, redistribution, resale, commercial use, or public display of MTech data or derivatives thereof is strictly prohibited.

4. Limitation of Liability and User Responsibility

By using MTech’s Services, you expressly waive any claim against MTech related to:

• Data accuracy or completeness
• Delays, interruptions, or data errors
• Any losses incurred through the use of MTech’s systems or data

You are solely responsible for:

• All market data subscription fees, access costs, and usage charges associated with your account.

MTech disclaims all responsibility for damages or losses arising from reliance on its Services or data.

5. Training Accounts and Data Delays

Accounts with the prefix “TR” are designated as training accounts.
All trading activity through these accounts is simulated for educational and training purposes only and does not represent live or executable trades.

Certain market data feeds may be subject to a 15-minute delay, including but not limited to:

• TSX
• CBOE & Russell Indices
• TSX Level 1

All other feeds are provided in real time, where available.

Any unauthorized access or use of MTech market data, systems, or Services will be considered theft of service, and MTech reserves the right to collect fees, fines, and pursue all remedies permitted by law.
